I have the honour to acknowledge the receipt

of Your Excellency's cypher telegram of the 28th Sept ember, 1921, in reply to my despatch of the 9th September, 1921.

I should like to emphasise again the point that the present difficulty is due, not to the fact that the form of government in China has been changed from an empire

to a republic, but to the fact that the present Civil Governor of the Province of Kwong Tung does not accept the authority of the only government of China which is recogn- ised by His Majesty's Government. I suppose that the strict diplomatic view of the present government of Kwong Tung must be that it is either a rebellion or a secession, or that it

In these is part of a rebellious or seceding movement. circumstances it is difficult to argue that the government of Kwong Tung is a provincial government within the intention of the Chinese Extradition Ordinance, 1889.

Your Excellency expresses the view that the proposed legislation would be in conflict with the treaty

I am basis of all proceedings connected with extradition. not quite clear what this means, but I would point out that extradition between Hong Kong and China is unilateral and not reciprocal. I would also point out that if the proposed legislation is in conflict with the treaty basis of
